Peace officers: deputy sheriffs
AB 2004 grants limited peace-officer status to Fresno and San Joaquin County deputy sheriffs assigned to jail custodial duties.
It gives those deputies the same statutory recognition and defined authority already provided to similarly assigned deputies in listed counties. The law does not expand their authority beyond custodial work or agency-directed emergency law-enforcement duties.
What the law does
- Adds Fresno and San Joaquin Counties to the counties whose custodial-assignment deputy sheriffs are peace officers.
- Authorizes those deputies statewide only while performing their custodial job functions or agency-directed law-enforcement duties during a local state of emergency.
- Covers custodial work involving inmate custody, care, supervision, security, movement, and transportation.
- Leaves collective bargaining, job classifications, compensation negotiations, and sheriffs’ personnel discretion unchanged.

- Deputy sheriffs in Fresno and San Joaquin Counties assigned exclusively or initially to county custodial facilities.
- Fresno and San Joaquin County sheriff’s offices and their county detention facilities.
